Frequently asked questions
What is the deadline for the estate tax return in Venezuela?
The estate tax return is filed with SENIAT within 180 days of the opening of the estate, which occurs on death. A justified extension can be requested. Late filing triggers fines and interest, and without the return the heirs cannot sell or register the deceased's assets in their names.
What if one heir refuses to sell or divide the inheritance?
No one is required to remain in co-ownership. If there is no agreement for an amicable partition, any heir can sue for judicial partition; the court orders the assets to be divided or, if they cannot be conveniently divided, sold and the proceeds shared.
When does a debt between individuals become time-barred in Venezuela?
As a general rule, personal claims are time-barred after ten years under the Civil Code, although shorter periods apply to certain obligations. The period can be interrupted, for example by a lawsuit or by the debtor acknowledging the debt, so the dates of each case must be checked.
